These are the Terms and Conditions of MyNextMattress. Please read through our Terms and Conditions carefully. We reserve the right to change these Terms and Conditions from time to time without notice. Any such changes will take effect from the moment they are posted on this page. 

1. Contract Arrangement and Liability

1.1 After placing an order, you will receive an email from us acknowledging that we have received your order. This may not mean that your order has been accepted.
1.2 If we are unable to supply the product and payment has already been received, then your Bank, Credit, Debit Card or PayPal account will be refunded and credited with the total sum paid. We can only refund back on to the original source of payment.
1.3 Please note that images of products on our site are for illustration only. Any item that is not specified in the product description but appears in the image(s) will not count as part of the order.
1.4 Our only liability under these Terms and Conditions will be to make good any shortage or non-delivery or to replace or repair defective or damaged goods ordered from us. We cannot be responsible for any consequential loss, loss of profits, damage to property or wasted expenditure.
1.5 MyNextMattress retains the right not to accept any order that is subject to an error on its website, and will in these circumstances reimburse any payments made in full.

2. Price and Payment

2.1 All prices displayed are inclusive of VAT.
2.2 The total sum of the goods and any applicable delivery costs will be taken at the point of order.
2.3 MyNextMattress has the right to verify that a customer has the right to use the Payment Card or Bank Account specified to place an order. We reserve the right to delay any shipping of goods until we are satisfied that an order is authorised and non-fraudulent. If we are not satisfied, the order will be cancelled and monies reimbursed.
2.4 All billing information must match that of the payment Bank or Card provider, and failure to supply this information may result in a delay, as set out in the point above.

3. Cancellation before Shipment

3.1 You may cancel your order after receipt of your order confirmation, but before receipt of the goods by contacting us in writing. You can email us at: [email protected]
3.2 We cannot accept cancellation of goods, which are made to your specific requirements or can be referred to as bespoke in size or specification.

4. Risk and Title

4.1 The goods will be at your risk from the time of delivery. Any goods delivered to your pre-assigned destination but accepted by another party shall also be at your risk.
4.2 Ownership of the goods shall only pass to you once full payment for the goods and delivery has been made.

5. Product and Service Details

5.1 MyNextMattress reserves the right to alter, amend and change any product description or image at any time. Any amendment will supersede any prior version.
5.2 All sizes stated are approximations only. All goods listed on MyNextMattress are produced to a level of tolerance of size. Colours and materials may not appear identical to that seen on this site. Images are for illustration purposes only.
5.3 Any item not carried in stock will be shown with an approximate lead time. We always try to keep this as accurate as possible, but from time to time, this lead time can vary. Where there are delays, we will try our best to notify you in good time.
5.4 MyNextMattress reserves the right to send you periodic promotional emails regarding exclusive promotions. You have the right to opt-out from receiving these via a link within the email.
5.5 Should a price match be required, we will require details of the competitors pricing, delivery fees and we will not match Amazon, eBay or any other auction site, nor Groupon or any other bulk sale site. We also do not match clearance or 'seconds'.

6. Warranty & Guarantee

6.1 All goods delivered to you will come complete with a warranty. This warranty length varies according to product and brand and is stated on the product’s information page.
6.2 To be able to claim against the warranty, we will require a description of the fault in writing (email) and at least two images of the product.
6.3 Some manufacturers may request an inspection is carried out, by claiming against the warranty, you accept this request, should it be made.
6.4 You cannot claim against the warranty if the defect is due to wear and tear, wilful damage or negligence.
6.5 If the defect is claimed and agreed as per the points above, then we will replace or repair as quickly as possible.
6.6 The warranty or guarantee of the product will be void should it be transported offshore (GB).

7. Delivery

7.1 Our carriers are contracted to deliver on our behalf. If you arrange for goods to be left with a neighbour or left in a specific location, neither MyNextMattress nor the carrier will be liable for any damage or theft of the goods.
7.2 If you will be disposing of your existing bed or mattress, please ensure this is done the day after the delivery is scheduled.
7.3 We will always make every effort to ensure delivery takes place within any pre-arranged timeslot. But this may not always be possible due to circumstances outside of our control. We cannot be liable for any consequential loss as a result of delivery outside of this timeslot.
7.4 If the goods are delivered damaged, or there is a part missing, you must clearly state this on the delivery note.
7.5 Signing the delivery note in any way will count as a clear POD (Proof of Delivery) and signing as ‘not checked’ or similar will be counted as a clear POD.
7.5a A signature will be required by the delivery driver. No assurance of delivery is given if a note is left for the driver. If you leave a note rather than being present, you must inform us in writing (email) prior to the delivery timeslot.
7.6 If for any reason the delivery is missed, cancelled or postponed by you and the carriage is already deemed chargeable by the carrier of choice, we may seek to recover this carriage charge from you. Costs range from £10 - £60 approximately, and are based on the location of the delivery and the weight and the size of the goods.
7.7 The disposal service offered as a service on our website or as a gift on our website is on a like-for-like basis. For example; a Double mattress purchased will result in a Double mattress collected. 
7.8 We reserve the right to refuse any collection / disposal on Health and Safety grounds. All items set for collection should be packaged prior to the collection drivers arriving. Refusal based on H&S grounds may result in collection charges not being refunded.
7.9 Cancellation of a delivery or collection service after the couriers have received details of your consignment may result in additional charges, typically the cost of the cancelled carriage service. Details can be provided upon request.
7.10 Should the goods not fit into the property (or be deemed as such by the delivery drivers), the cost of returning the goods to us may be passed to you. Details can be provided upon request. It is solely your responsibility to ensure the goods will fit into the property safely.

PLEASE TAKE TIME TO INSPECT THE ITEMS ON ARRIVAL. A CLEAR POD MAY PREVENT US FROM REPLACING DAMAGED ITEMS.

8. Returns and Refunds

8.1 By purchasing from MyNextMattress, either by phone or through the website you have 14 calendar days from the day after delivery to notify us of any reason why you are unhappy with the goods. We require this notification in writing (email).
8.2 By confirming that you are unhappy with the items for any reason, we can offer a refund or a replacement.
8.3 The returning goods must be received at our warehouse in perfect condition and in the original unopened packaging. Only once we have inspected the goods will the risk of these items be transferred from you to MyNextMattress. Up until this point, the goods will remain your property. Our warehouse address can be supplied upon request.
8.4 If you require us to collect the goods with one of our contracted carriers, there will be a cost. This cost will depend on your location and the nature of the goods. Our carriers will not insure your goods for this return journey.
8.5 In the event that the original packaging is unsuitable for use or has been discarded, we may charge you the sum of £25 to deliver additional packaging for the goods to be returned in.
8.6 In the event of cancellation of an order, any free gifts offered must also be returned. If this is not possible (disposal service, pillows or bedding, digital vouchers or weekend delivery, for example) then we may seek to recover those costs. This sum will be deducted from any refund value.
8.7 Consumers in the UK have 30 days to report faulty and or damaged goods and to exercise their right of withdrawal from a distance contract or off-premises contract (including internet sales) without the need to justify and at no cost (except supplementary costs).
8.8 All refunds will be processed as soon as goods are received into our warehouse, but not longer than 14 days from the day of collection.
8.9 If the Sleep Trial is utilised, orders will be adhere to the period of sleep trial on the first purchase. IE a 14 night sleep trial will not be replaced by a longer period on a subsequent mattress.
8.10 As per 3.2; we cannot accept the return of goods, which are made to your specific requirements or can be referred to as bespoke in size or specification unless a fault or damage is determined.
8.11 Our Sleep Trial (of any length) does not apply to Clearance items, Pillows, Mattress Protectors or Mattress Toppers.
8.12 Our Sleep Trial (of any length) does not apply to goods shipped offshore (GB).
8.13 In the event of a refund via your bank, card provider or any other similar payment provider, such as a Section 75 refund or 'chargeback', the goods will become our property and must not be discarded unless we have given permission in writing.
8.14 Upon notification of the outcome of any refund originating via a third party payment method in relation to 8.13, you must notify us in writing as soon as you are aware of this outcome in order for us to arrange for retrieval of the good(s).
